Article 1 – Definitions, Application and approval of terms and conditions
1.1 L’Original SPRL offers the ability to order and sell products. This is an independent business operating under the name L’Original Namur, company registration number BE 0633 718 915, located at Rue de l’ange 6, 5000 Namur (Belgium) (hereinafter the Seller, L’Original our L’Original Namur). These are the Seller’s terms and conditions of sale.
1.2 “Buyer” refers to any natural or legal person purchasing one of more products from the online shop and any visitor to the online shop.
1.3 These terms and conditions of sale apply to purchases offered and completed via the online shop https://www.loriginalnamur.com/ or other agreements entered into via the online shop.
1.4 Placing an order means accepting these general terms and conditions and waiving the Buyer’s own terms of purchase and delivery.
1.5 By placing an order through the online shop, the Buyer is declaring that it has noted the terms and conditions of sale, and the Buyer accepts the terms and conditions of sale by checking the appropriate box.
1.6 If in a court of law one or more articles in these general conditions are declared null, the other provisions of these terms and conditions of sale remain fully in force.
Article 2 – Conclusion of the Agreement
2.1 A sales agreement is only entered into between the Seller and the Buyer when the Buyer or potential Buyer’s order is explicitly accepted by the Seller, who will inform the Buyer of this by means of a confirmation note. The Seller reserves the right not to accept the order without owing the Buyer any compensation, but subject to the reimbursement of any sums paid.
Article 3 – Prices
3.1 All prices are given in Euro and all payments must be made in Euro.
3.2 All our prices include VAT but don’t include the delivery cost ( if there is any ).
3.3 The Seller reserves the right to change prices at any time. However, products are invoiced based on the rates applicable at the time the order is accepted.
3.4 If the price is increased, the Buyer is entitled to terminate the agreement without incurring any costs; nor shall the Seller be bound to pay any compensation.
3.5 Products remain the property of the Seller until the Seller has definitively received payment for the full price.
Article 4 – Payment
4.1 The following payment options are available when ordering products from the online shop:
– PayPal
– by credit card: Visa, Mastercard, Maestro and American Express
– by Bancontact: Bancontact/MisterCash
Of course when using the aforementioned payment systems the Buyer must respect any terms and conditions applied by the operators involved. The Seller is not a party in the relationship between the Buyer and the payment system operator.
4.2 The Seller undertakes to ensure the security of online shop users to the best of its ability; however, under no circumstances can the Seller be held liable for possible damages incurred through the use of the online shop and, in particular, damages cased by third parties who may be abusing the website or the payment system.
Article 5 – Delivery
5.1 Products will be shipped to the shipping address given when the order is placed.
5.2 The Seller undertakes to do their utmost to deliver the order within 1-3 days.
5.3 If the aforementioned undertaking cannot be achieved, a further delivery date may be agreed between the Seller and the Buyer.
Article 6 – Right of renunciation
6.1 Right of renunciation applies solely to purchases made through the online shop
6.2 If you have informed us that you wish to withdraw from the sale within 4 hours, we will contact you to arrange a change or refund.
6.3 The Seller shall refund any sums paid within 7 days from the date the cancelation of the order has been agreed.
6.4 Return of goods will only be accepted within certain conditions and have to be approved by the Seller.
6.5 The delivery cost of returns will be of charge of the Buyer.
6.6 We reserve the right not to deliver in the event that the stock level was incorrect at the time of receiving the order. Should we be unable to deliver in accordance with the terms in the confirmation of order, we will contact you and give you the opportunity to cancel the order.
6.7 Parental or guardian consent is required for customers under the age of 18.
6.8 L’Original Namur has the right to assert force majeure in the event of war, warlike event, civil war, revolution,government sanction, strike, lockout, blockade, natural disaster or the like. This means that the agreement will not need to be fulfilled in part or in full. Should this, contrary to expectation, occur,we would attempt to notify you.
6.9 No exchange possible from Switzerland but a return is possible if the customer bears the shipping costs and customs fees. L’Original Namur has the right to refuse the return package if the customs fee has not been paid.
Article 7 – GDPR & Cookie Policy
7.1 We reserve the right to save and process all data relating to the customer insofar as doing so is necessary to execute the sale, and to do so for as long as we are bound to retain such data in accordance with applicable legislation.
7.2 We shall not make any of the customer’s personal data available to third parties without the express consent of the customer, except to the extent we are bound to disclose said details under applicable legislation.
7.3 We are not permitted to collect customers’ personal data, transfer them to third parties, or otherwise process them for purposes not defined in our Privacy Policy.
Article 8 – Online Dispute Resolution
Effective as of 15 February 2016, the European Commission has created a platform for extrajudicial dispute resolution. This offers consumers a way to resolve disputes relating to online orders without having to become involved in a judicial procedure involving courts and judges. Article 9 – Applicable Law
9.1 Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of Belgium without giving effect to any principles of conflict of law.
9.2 You hereby consent to the exclusive jurisdiction of the High Court of Belgium in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
